China unveils lists of U.S. products to be excluded from additional tariffs

Under Announcement of the Customs Tariff Commission of the State Council on the Trial Implementation of the Exclusion of U.S. Products Subject to Additional Tariffs (Tariff Committee Announcement [2019] No. 2), on September 11th, the Customs Tariff Commission of the State Council, approved by the State Council, issued the first set of lists of U.S. goods to be excluded from the first round of additional tariffs on U.S. products. The exemption will become effective on September 17th, 2019. In the list,

 

From September 17th, 2019 to September 16th, 2020, the goods listed in Annex 1 will not be subject to the additional duties that China has imposed as a result of 301 Clause against the United States. The duties already imposed will be refunded, and the relevant import enterprises should apply to the customs in accordance with regulations within 6 months from the date of promulgation of the exclusion list.

 

From September 17th, 2019, to September 16th, 2020, the goods listed in Annex 2 will not be subject to the additional duties that China has imposed as a result of 301 Clause against the United States. The duties already imposed will not be refundable.

 

Next, the Customs Tariff Commission of the State Council will continue the implementation of the exclusion of U.S. products subject to additional tariffs, and will release the subsequent set of lists of U.S. goods to be excluded from the additional tariffs on U.S. products in due course.
